How to check an apartment in Batumi and complete the transaction safely

Legal verification of real estate is needed not only when buying a secondary apartment. In a new building, it is also necessary to check the company, land plot, permits, contract and procedure for registering the rights of the buyer. The earlier the risk is identified, the easier it is to change the conditions or choose another object.

The review should not be limited to one document. It includes information from the Public Register, documents of the parties, technical characteristics and contents of the agreement.

1. Extract from the Public Register

The extract allows you to see the cadastral code, registered owner, characteristics of the object and existing rights or restrictions. The information in the statement must correspond to the apartment or plot specified in the contract.

Check the document's relevance. An old statement cannot be considered sufficient confirmation of the condition of the object on the date of the transaction.

2. Owner and powers of the seller

If an apartment is sold by an individual, his data must match the register and identification document. If a representative acts, the power of attorney, scope of authority and validity period are checked.

When selling by a legal entity, it is necessary to establish its registration data and the powers of the person signing the contract on behalf of the company.

3. Mortgage, pledge, arrest and other restrictions

The presence of a restriction does not always mean that a transaction is impossible, but the procedure for removing it must be clear and recorded. For example, with a mortgage, part of the payment may be sent to the lender according to an agreed procedure.

You cannot rely on the seller's verbal promise to lift the restriction after receiving the full amount. The sequence of actions and payments is determined before signing.

4. Checking the new building and the developer

In a new building, the future service payment, operating rules, the possibility of self-rental, and the obligation of an agreement with the management company are specified in advance.

8. Payment and supporting documents

Money is transferred according to the details specified in the contract or official account. The purpose of the payment should allow it to be associated with a specific apartment and agreement. The buyer retains confirmation of all transfers and documents confirming receipt of funds.
